    Company could owe $4.7 million over insurance fraud claims

    Getty Images/iStockphoto A purported health care cost-sharing company, which was once deemed “ruthless in denying coverage” by “Last Week Tonight’s” John Oliver, has lost a $4.7 million lawsuit in Lexington federal court. The Aliera Companies, which created and marketed “fraudulent” health care coverage, has lost a class-action lawsuit resulting in a nearly $4.7 million judgment. A judge in a Lexington federal court ruled against the company earlier this month after the company’s representatives failed to appear in court multiple times, according to records. Senior U.S. District Judge Joseph M. Hood declared that the company should have been subjected to Kentucky

    Seattle woman sentenced to prison for embezzling from high-end mountain bike company | USAO-WDWA

    Seattle – A Seattle woman who was employed as a contract bookkeeper and accountant for a high-end mountain bike company was sentenced November 19, 2021, in U.S. District Court in Seattle to 28 months in prison for wire fraud and aggravated identity theft, announced U.S. Attorney Nick Brown.  Joan C. Trower, 51, pleaded guilty in August 2021.  At the sentencing hearing, Chief U.S. District Judge Ricardo S. Martinez said that it is part of the Court’s “job to protect the community, especially small businesses such as the victim in this case.” According to records filed in the case, Trower worked

    Insurance company fighting payment of $62 million judgment against TEH Realty affiliates

    An insurer for affiliates of a former Kansas City-area landlord has asked a federal judge to say the insurance company should not have to pay any part of a $62 million judgment. That historic judgment entered in Jackson County court last year cited unsafe living conditions in apartments owned and managed by an affiliate of TEH Realty.The North American Capacity Insurance company filed an amended federal lawsuit earlier this week. The suit asks a judge to confirm it rescinded coverage of four insurance policies for affiliates of TEH Realty, citing the affiliates’ failure to notify the insurance company of apartment

    Attorney’s Financial Management Company Deemed Conflict of Interest

    On Oct. 6, the New York State Bar Association Committee on Professional Ethics (the Committee) issued Ethics Opinion 1231, in which it determined that an estate-planning attorney, who proposed setting up a financial management company that managed trust assets, would have a conflict of interest that would require clients’ informed consent, to be confirmed in writing, at the outset of the attorney’s representation. The Committee also determined that if the financial services provided by the management company, and the legal services provided by the estate-planning attorney, weren’t distinct from each other, the attorney would be subject to the New York
